Simp Gifts provides (a) a platform through its website at www.simp.gifts and attendant mobile applications (collectively, with any new features and applications, the "Platform") and the Simp Gifts Community and related services (collectively, with the Platform, the "Simp Gifts Services"). The Platform provides information about Simp Gifts, and explains how users can post a product gifts, fundraiser, accept monetary donations, and details our related services (together with the Platform, the "Services") to users and visitors ("you" or "your").
This Privacy Policy (the "Policy") describes and governs how we collect, use, share, and protect information collected in the context of our Services. This information is collected passively by using various technologies, and includes the type of geolocation information, Internet browser or mobile device you use, any website from which you have come to the Services, your operating system, and location data through an IP address that identifies the city and state where you logged into the Platform or your precise geo-location if you have permitted your mobile device to provide that information to us. Simp Gifts either stores such information itself or such information is included in databases owned and maintained by Simp Gifts, and/or its agents or service providers.
The Services may require that you provide your zip code, city or town, and state or province of residence.
When you interact with the Services, we try to make that experience simple and meaningful. When you visit our Platform, our web server, business providers, and/or the Social Networking Services (defined below) are integrated into the Service, we use cookies or other electronic technologies (such as web beacons or pixel tags) for various purposes. Cookies are small pieces of information that are issued to your computer or mobile device when you visit a website, or access or use a mobile application. That information regarding your use of the Platform is stored and sometimes tracked. Web beacons are transparent image files, which enable the Platform to track website usage information. Unlike cookies, web beacons are not placed on your computers. Pixel tags are tiny graphic images with unique identifiers that track online movements of our users. Unlike cookies, pixel tags are embedded in web pages. We will refer to the cookies and other technologies identified here collectively as "Cookies" for purposes of this Policy.
Some Cookies are strictly necessary to make our Services available to you ("Essential Cookies"). For example, Essential Cookies are used to provide the chat and login functionality and to remember your consent and privacy choices. We cannot provide our Services without these Essential Cookies.

However, please remember that the manner in which Social Networking Services use, store, and disclose your information is governed by the policies of such third parties, and Simp Gifts shall have no liability or responsibility for the privacy practices or other actions of any Social Networking Services that may be enabled within the Services. For example, if you upload a video onto your product using the mobile application for the Platform, your video will be uploaded using YouTube and subject to Google's Privacy Policy and Google's Security Settings. You also have the option of using single sign on or posting your activities to Social Networking Services when you access content through the Services. By proceeding, you are allowing the Social Networking Service to access your information on the Platform, and you are agreeing to the Social Networking Service's terms of use and privacy policy in your use of the Service. You further acknowledge that if you choose to use this feature, your friends, followers, and subscribers on any Social Networking Services you have enabled will be able to view such activity. For example, if you sign on using Facebook, Facebook's privacy policy and terms of service would apply to the data Facebook might obtain from your activities on Simp Gifts. We use web analytics vendors on our Services, such as those of Google Analytics, to help us analyze how users use the Services, including by noting the website from which you arrive, and providing certain features to you including Google Signal features such as user id tracking, dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, display advertising, and video ads reporting. The information (including an anonymized IP address) collected by the technology will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services. This information can be used to place interest-based advertisements on the Platform. This may result in you seeing advertisements for our Platform when you visit other websites. We use Cookies to collect information about your access to and use of the Platform, including to: (1) allow you to navigate and use all the features provided by our Platform; (2) customize elements of the layout and/or content within the Platform and remember that you have visited us before; (3) identify the number of unique visitors we receive; (4) improve the Platform and learn which functions of the Platform are most popular with users; and (5) understand how you use the Platform (e.g., by learning how long you spend on the Platform and where you have come to the Platform from). The Services may provide chat, forum or bulletin board tools to users and the ability to create an "avatar," cover picture, or other customized profile and Account information for creators. Information that you provide through the use of these tools will be available to the public generally. Simp has no obligation to keep private any information that you disclose to other users or the public using these functions. You should exercise caution when deciding to disclose Personal Information through the use of these tools or functions. We strongly recommend that you do not post any information through the Services that allows strangers to identify or locate you or that you otherwise do not want to share with the public.
Notwithstanding the above, a creator's delivery address and email address provided to us in order to receive gifts from creator's wish list will not be available to the public generally or to the gifter.
Simp Gifts uses the information collected from the Services in a manner that is consistent with this policy. We use the information that you provide (or otherwise permit the Services to access) for the following purposes:
(i) to further our legitimate interests in providing the Services, including without limitation to collect and remit payment for paid features, (ii) to administer your use of the Services and any Accounts you may have with us, (iii) to personalize your experience, (iv) to provide to you Service announcements or inform you of new releases and features, (v) to provide you with further information and offers from us or third parties that we believe you may find useful or interesting, such as newsletters, marketing or promotional materials, (vi) to perform tasks on behalf of and according to instructions of a third party, such as payment processors, third party-service providers or our advertising partners, (vii) to enforce our Terms of Service, (viii) to resolve any disputes between users of the Site or between such users and us, (ix) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (x) to further our legitimate interest in protecting our rights, property, or safety and the rights, property and safety of the Services, our users or the public, and (xi) to contact you to obtain feedback from you regarding the Site and the Services

In addition, we may call you if you are not responding to email and your gift is subject to refunds.
We also use the information we collect to send you communications relating to the Services, such as updates on events, communications relating to products and services offered by us and by third parties, and communications about services we believe will be of interest to you. For example, we can send periodic emails to registered users of the Services relating to their recent interactions with the Services, such as new feature releases and other materials.
If you are located in Europe, we are processing this information as necessary (i) to fulfill our obligations under our contract with you or in order to take steps at your request prior to entering into a contract, or (ii) for our legitimate interest, such as, to maintain our relationship with you (including direct marketing) or to protect you and us against fraud.
If you access the Services through a mobile device and if you have chosen to provide us with your mobile number, or other electronic means to your mobile device, you agree that we can communicate with you regarding your Simp Gifts account by SMS, MMS, text message.
Further, when setting up your Simp Gifts account, if you click "Send code" by "Text Message," you agree to receive automated text messages related to your account from or on behalf of Simp Gifts at the phone number provided. You can reply STOP to such text messages to cancel, except for automated text messages related to the security of your account. Message frequency will vary. Message and data rates may apply. In the event you change or deactivate your mobile telephone number, you agree to promptly update your Simp Gifts account information to ensure that your messages are not misdirected. Please note that your wireless service carrier's standard charges, data rates, and other fees may apply where you access the Services through a mobile device. In addition, downloading, installing, or using certain Services on a mobile device may be prohibited or restricted by your carrier, and not all Services may work with all carriers or devices.

We use the information we collect to operate, maintain, and provide our Services such as enabling access to the Platform, customer support, or to complete transactions.

We use the information we collect to secure our Services and to verify identity, prevent fraud, and to continually improve these aspects of our Services. This includes our request for your (mobile) telephone number to conduct multi-factor authentication when you create an account and/or at the time you set up withdrawals as a beneficiary.
If you are located in Europe, we process this information as necessary for our legitimate interest in maintaining the security or our systems, protecting our business, and/or protecting you and us against fraud.
We use the information we collect to analyze data usage trends and preferences in order to improve the accuracy, effectiveness, security, usability or popularity of our Services. We further use data in connection with our research on our customer demographics, interests, and behavior.

We use the information we collect, such as device identifiers, to learn how users interact with our Services in order to personalize the content of our Services, such as customizing the language and services on our homepage based on your location.

We may present links in a format that enables us to keep track of whether these links have been followed. In addition, as a creator, you may opt to link your Account to your social media account or other accounts, such as Google, in accordance with your Account settings (which you may change at any time) and respective policies of these third parties. This Privacy Policy applies only to the Site and the Services. We do not exercise control over third party services or other websites that provide information, or links from within the Site or the Services. Your interactions with these third party services are governed by the privacy policy of the company providing it. These other sites and services may place their own cookies or other files on your computer's browser, collect data or solicit Personal Information from you. Other websites and services follow different rules regarding the use or disclosure of the Personal Information that you submit, and the collection and use of such information and access of any third party websites are subject to such third party's privacy policy. We understand the importance of privacy and security of Personal Information to our users and have made them a priority. Simp uses a variety of industry-standard security technologies and procedures to help protect Personal Information about you from unauthorized access, use, or disclosure and trains Simp employees on privacy and security issues. However, we cannot guarantee that unauthorized third parties will never be able to overcome those measures or use your Personal Information for improper purposes, and we do not promise that Personal Information about you or private communications will be protected from unauthorized disclosure or use.
Some web browsers transmit "do-not-track" signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
We keep your data on your behalf and for your benefit. You can correct or terminate and delete your Account information by following the instructions on the Services or by e-mail at hello@simp.gifts, which you may also access for further assistance and questions regarding the Privacy Policy or for a copy of your Account data as a creator. If you cancel your Account as a creator or request us to delete your information, Simp will limit its access to Personal Information to perform what is requested by you and will delete information accessible to Simp within 14 business days.
We take steps to help ensure that you are able to exercise your rights regarding Personal Information about you in accordance with applicable law. If you would like to access, review, erase, withdraw your consent, or object to, or restrict the processing of Personal Data we collect about you, you may submit a request to hello@simp.gifts. We will promptly review all such requests in accordance with applicable laws. Depending on where you live, you may also have a right to lodge a complaint with a supervisory authority or other regulatory agency if you believe that we have violated any of the rights concerning Personal Information about you. We strive to comply with all applicable privacy and data security laws, including the EU's General Data Protection Regulation ("GDPR") and the California Consumer Privacy Act of 2018 ("CCPA"). We currently do not share or disclose your Personal Information to third parties for the third parties' direct marketing purposes. If we change our practices in the future, we will implement an opt-out policy as required under California laws.

You may submit a request to know using one of the methods described below in "Methods for Submitting Consumer Requests and Our Response to Requests". The delivery of our response may take place electronically or by mail. We are not required to respond to requests to know more than twice in a 12-month period.
We do not sell, and have not in the prior 12 months sold, Personal Information about California residents. Therefore, we have not included a "Do Not Sell My Personal Info" link on our Site. If our practices change, we will update this Privacy Policy and take any other necessary action to comply with applicable law. We do, however, disclose Personal Information for business purposes as described in the "Third Parties We Share Personal Information With" section above.
You have the right to request that we delete any Personal Information about you that we have collected. Upon receiving a verified request to delete Personal Information, we will do so unless otherwise required or authorized by law. You may submit a request to delete Personal Information using one of the methods described below in "Methods for Submitting Consumer Requests and Our Response to Requests".
You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an authorized agent that has been provided power of attorney pursuant to Probate Code sections 4000-4465 may submit a request on your behalf.

Upon receipt of a request, we may ask you for additional information to verify your identity. Any additional information you provide will be used only to verify your identity and not for any other purpose.
We will acknowledge the receipt of your request within 14 days of receipt. Subject to our ability to verify your identity, we will respond to your request within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. In order to protect your privacy and the security of Personal Information about you, prior to taking action on any request we will verify your identity.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

For the purposes of the GDPR, Bond Group Ltd. is the Data Controller of the Personal Information that we collect from you. Simp is based in the Canada and, as a result, Personal Data that we collect in and through the Services and on the Site may be transferred to our Canada offices. In addition, we may work with third-party service providers in the U.S. and in other countries to support our business activities. Thus, Personal Information may be transferred to, stored on servers in, and accessed from the United States and countries other than the country in which the Personal Information was initially collected. In all such instances, we use, transfer, and disclose Personal Information solely for the purposes described in this Privacy Notice and in compliance with applicable laws. We use the EU's approved Standard Contractual Clauses for the transfer of Personal Data (as defined in the GDPR) collected in the European Economic Area to third countries.
We keep Personal Information related to your Account for as long as it is needed to fulfill the purposes for which it was collected, to provide our services, to deal with possible legal claims, to comply with our business interests and/or to abide by all applicable laws. Thereafter, we either delete Personal Information about you or de-identify it. Please note that even if you request the deletion of Personal Information about you, we may be required (by law or otherwise) to retain the Personal Information and not delete it. However, once those requirements are removed, we will delete Personal Information about you in accordance with your request.
Our security and Privacy Policy are periodically reviewed and enhanced as necessary. This Privacy Policy might change as we update and expand the Services. There are certain circumstances in which we disclose information collected through the Services with certain other parties without further notice to you, as set forth below.
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, similar event, or steps taken in anticipation of such events (e.g., due diligence in a transaction), user information may be part of the transferred assets.
We disclose your personal information among the Simp Gifts entities, including our affiliates and subsidiaries, in order to provide our Services including hosting; marketing and publicizing gifts; providing you with customer support; administering funds in connection with gifts; authenticating donors; sending you communications; and conducting the other activities described in this Notice.
Simp Gifts contracts with other companies to perform certain business-related functions on Simp Gifts's behalf, and we provide access to or disclose your information with these companies so they can perform services for us. Examples of such functions include marketing, mailing information, data storage, security, identity verification, fraud prevention, payment processing, legal services, and maintaining databases. We limit the personal information provided to these vendors and entities to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such information.
Simp Gifts discloses personal information with third parties that partner with us on various initiatives and/or that offer services you choose to link to your Simp Gifts account. Examples of this are Social Networking Services and their integrated social media tools or "plug-ins,". When Simp Gifts shares personal information with third parties, we require those third parties to handle the information in accordance with relevant laws. When you link to or interact directly with third-party companies (or you donate to Simp Gifts that are linked), their use of your personal information and your use of their features are governed by the privacy notices of those companies. Simp Gifts may access, disclose, transfer and preserve your information when we have a good faith belief that doing so is necessary to: (i) comply with the law including with subpoenas, search warrants, court orders, and other legal process; and respond to inquiries or requests from government, regulatory, law enforcement, public authorities, or content protection organizations; (ii) protect and defend the legal rights, privacy, safety or property of Simp Gifts, its affiliates, subsidiaries, employees, agents, contractors, or its users; (iii) permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages we may sustain; or (iv) enforce this Notice or any applicable Terms of Service.
In certain situations, we may disclose your information in the event that you consent to the disclosure of your information. For example, we may partner with third party organizations to arrange for specific gifts. If you consent to our providing your contact information to a specific partner, we disclose, with the partner organization, your name, email address and other information you have provided in connection with your gift.
We aggregate, anonymize and/or de-identify information collected actively or passively about you so that the information no longer relates to you individually. We then use that data for various lawful purposes, including but not limited to our research on our customer demographics, interests and behavior. We also disclose this information with our affiliates, agents, business partners, research facilities or other third parties (e.g., Google Analytics).
